Biographical

For over 20 years, Scott litigated high-stakes, high-profile, and complex cases for Fortune 500 companies, small businesses, and individuals (from farmers to C-suite executives) in state and federal courts across Texas and the country.  He mediated, negotiated, or litigated just about every type of civil and commercial dispute.  His clients were plaintiffs about as often as they were defendants.  He worked for contingent fees and by the hour.  Scott practiced at an AmLaw 100 national and international firm, a top-tier Austin-based regional firm, and a small litigation boutique.  He's been in trenches similar to the ones that you and your clients are in.  He understands the toll of litigation on a client's finances, time, focus, energy, and productivity and that the best solution to nearly every dispute is created by those affected by the dispute--not by a jury, court, or arbitrator who imposes terms that parties can't control.  

Scott focuses his knowledge, experience, and determination to help individuals and companies resolve disputes on their own terms.  Scott has served as a neutral mediator since 2014 and, since 2019, mediation is his sole focus--it's all that he does and he loves doing it.  He has helped hundreds of parties resolve conflict.  Scott has been recognized for his mediation skills and efforts by induction into the National Academy of Distinguished Neutrals and being named as an Top Attorney (mediation and arbitration category) by Austin Monthly Magazine.

Rates Information

Full-day:  In-person: $2,275 per party.  Videoconference: $2,150 per party.

Half-day:  In-Person: $1,450 per party.  Videoconference: $1,375 per party.

Disputes with under $50,000 total amount in controversy:: $975 per party (half-day, videoconference).

These fees apply to:

  • A two-party mediation and, for an in-person mediation, at a location provided by the parties--typically at the offices of one party's lawyers (SBM can arrange a facility if the parties are unable to provide one).  For multi-party mediations, the per-party fee decreases.  Contact Scott for the charges applicable to a multi-party mediation or if the parties do not have a facility available to them.
  • Mediations conducted within 75 miles of Austin.  Scott regularly travels for in-person mediations (he has conducted in-person mediations in Dallas, Houston, San Antonio, El Paso, Midland, and College Station).  For most in-person mediations that are more than 75 miles from Austin, SBM does not charge an additional fee (the parties reimburse only travel expenses with no markup).
